Chris Dawson, a 70-year-old one-time rugby league player, is expected to be flown back to NSW on Thursday morning to face formal charges and then court.
Arrested in Queensland on Wednesday, the 70-year-old is to be extradited to New South Wales, where the murder allegedly occurred.
"NSW police will seek an extradition".
Detectives from the NSW homicide squad began reinvestigating her suspected murder in 2015 and sent a brief of evidence to the Director of Public Prosecutions in April this year.
NSW police had amassed "an enormous amount of evidence".
Lyn Dawson was 33 years old when she vanished from her home in Sydney's northern beaches in January 1982, leaving behind two daughters.
Paul Dawson applied for bail, promising to drive himself to Sydney for the court appearance. Image: AAP Police remained at the home for a week. Once he returns to NSW he will be formally interviewed by police, and is expected to be charged with her murder.
He was arrested in Queensland and would be brought to New South Wales.
Fuller said authorities have not located Dawson's body, and that finding her remains is "not crucial to finalising the matter", but maintained "we certainly won't give up on that search".
"That information enabled New South Wales Police to get an arrest warrant for a 70-year-old man now living in Queensland", Fuller told reporters Wednesday.
It was revealed that Chris Dawson went "quietly" with police following his arrest this morning, and that no new evidence was found during the September dig at the Bayview property.
"Its taken a long haul but its going to be a very good Christmas for our side of the family knowing that we've finally got somewhere and we're going to find out what actually happened through the court system", he told the program.
As fans of the podcast will know, her husband Chris, a former rugby player and PE teacher at a local high school has always been suspected of involvement. She became the family's babysitter and months later the pair became involved in a sexual relationship.
The unnamed woman reportedly met with detectives in recent weeks.
Chris Dawson has been refused bail over his wife's death.
"As a result of the investigation and as a result of information that has come from the public, this week we received wonderful information from the DPP that there was sufficient evidence to prosecute", he says.
