It ended with a man shot to death in front of his young son. Pinellas County Sheriff Bob Gualtieri said the state would not bring charges against Drejka, as the shooting "is within the bookends of "stand your ground" and within the bookends of force being justified". "I enforce the law", Gualtieri said.
The vigil for the family of Markeis McGlockton, 28, who the Pinellas County sheriff said was killed by Michael Drejka, 47, will be held from 4 to 5 p.m.at Mt. Carmel Baptist Church in Clearwater, according to a news release.
Surveillance footage shows McGlockton then walked out of the store and shoved Drejka to the ground.
Immediately after going down, Drejka shot McGlockton in the chest. The entire confrontation lasts just six seconds. I'm just sitting, waiting for my family to come back to the auto, ' she said.
"Maybe somebody could make the case that this guy could've handled this differently, but that's why you've got a range and you've got bookends and you're going to have things that fall toward one end of the bookend or the other, that aren't squarely in the middle".
"He told deputies that he had to shoot to defend himself".
The sheriff's comments surprised Tampa attorney Anthony Rickman.
"There was no physical violence", said Gualtieri. I dont know what it was because it was dark, but I started to go towards my door, once he got me towards my screen door, I just, I had no choice, I, Im on my property " Julian told a police dispatcher in a 911 call.
You may recall the Stand Your Ground law was changed a year ago. Those are the facts and that's the law. The law exempts people who use force from prosecution if they fear for their lives. The legislature changed the law. He explained that the burden of proof for "stand your ground" entitlement used to be on the defendant but now the State Attorney must prove that the shooter is not entitled to a "stand your ground" defense.
The store owner tells ABC Action News that Drejka has a history of assaulting people in the very parking lot the shooting took place.
"Before Stand Your Ground, a case like this probably would have a different outcome". That's when McGlockton is seen running out of the store and confronting Drejka directly, slamming him to the ground. "That pause gives me some concern".
Zimmerman was arrested and charged with second-degree murder and manslaughter.
Two of McGlockton's children, a four-month-old and a three-year-old, were in the vehicle at the time of the shooting.
Britany Jacobs, the girlfriend of Markeis McGlockton, wants "justice" for the shooting of her boyfriend.
